Terms of service.

 1. Introduction

These terms and conditions form the basis of your contract with Lagom Escapes (“we”, “us”, “our”), a partnership registered in the United Kingdom. Please read them carefully as they set out our respective rights and obligations. By making a booking with us, you confirm that you understand and agree to be bound by these terms and conditions.

2. Booking and Payments

a. A deposit of 25% of the total booking is required at the time of booking.

b. The balance must be paid no later than 60 days before the start of the hike.

c. If the balance is not received by the due date, we reserve the right to cancel your booking and retain the deposit.

d. Bookings made within 60 days of the start date must be paid in full at the time of booking.

 

3. Cancellations by You

a. If you need to cancel your booking, you must notify us in writing. The following cancellation charges will apply:

  • More than 60 days before the start date: 100%* of the total price.

  • Between 30 and 60 days before the start date: 50% of the total price.

  • Less than 30 days before the start date: 100% of the total price.

    *Please note: For bookings on the ‘Carros de Foc’ challenge, a cancellation charge of £100 will be deducted from the deposit due to the mountain huts’ cancellation policy, which is unfortunately beyond our control.

 b. We recommend you take out comprehensive travel insurance to cover cancellation costs.

 

4. Changes by You

If you wish to change your booking (e.g., change the dates), we will do our best to accommodate you, subject to availability. An administration fee of £50 may apply.

 

5. Cancellations or Changes by Us

a. In the unlikely event that we need to cancel your booking, we will offer you a full refund of all monies paid or an alternative date or tour.

b. We may cancel or make significant changes due to circumstances beyond our control (force majeure), such as natural disasters, pandemics, or government restrictions. In such cases, we will not be liable for any compensation beyond the refund of payments made to us.

 

6. Weather Conditions and Trip Amendments

a. The Mountains are an environment where weather conditions such as wind, rain, snow, and sudden temperature changes can impact safety.

b. We reserve the right to amend the itinerary, alter routes, or cancel certain activities if weather conditions present a risk to the safety and well-being of participants.

c. In the event of such changes, we will make every effort to provide an alternative plan, but no refunds or compensation will be offered if the trip is altered or curtailed due to weather conditions.

d. We recommend that all participants be prepared for variable weather and carry appropriate clothing and equipment.

 

7. Fitness, Ability, and Responsibility

a. Participation in our hikes requires a good level of physical fitness and, in some cases, a good head for heights. It is your responsibility to ensure that you are adequately fit and prepared for the multi-day challenge or individual day hike.

b. By booking a hike, you confirm that you are physically capable of completing the activity as described in our itinerary.

c. If you are unable to complete the hike for reasons other than injury (e.g., lack of fitness, fatigue, or discomfort with heights), we will not be held responsible for any costs incurred to return you to the nearest town, including transport or accommodation expenses.

d. We strongly advise all participants to train adequately in advance and seek medical advice if you have any concerns about your fitness level.

e. In the event that you need to abandon the hike, you will be responsible for arranging and covering the costs of your return, including accommodation, transport, or any other additional expenses.

f. Injury-related issues will be handled with appropriate care, but general unpreparedness or fitness-related difficulties will not warrant any refund or compensation.

 

8. Health and Safety

a. Participation in hiking activities involves an element of risk. By making a booking, you confirm that you understand and accept these risks.

b. Medical Disclosure: It is your responsibility to disclose any pre-existing medical conditions, disabilities, or health factors that could affect your ability to participate in the hike. This includes, but is not limited to, conditions related to physical fitness, respiratory or cardiovascular health, and any other factors that may hinder your ability to complete the tour safely. Failure to disclose such conditions may result in exclusion from the tour, and no refund will be provided in such cases.

c. It is your responsibility to ensure that you are physically fit to participate in the activities.

 

9. Insurance

a. You are required to have suitable travel insurance that covers hiking and adventure activities, including medical expenses, personal injury, and repatriation.

b. We are not responsible for any costs incurred as a result of inadequate insurance coverage.

 

10. Liability

a. We are not liable for any loss, injury, or damage to personal property unless caused by our proven negligence.

b. Our liability is limited to the amount paid by you for the hiking tour.

c. We do not accept responsibility for any loss, injury, or damage arising from factors beyond our control, such as extreme weather conditions, the actions of third parties, or government actions.

 

11. Governing Law

These terms and conditions, and any dispute arising from them, are governed by the laws of England and Wales. Any legal proceedings will be conducted in the English courts.

 

12. Complaints

If you have any complaints during your hike, please inform your guide or contact us immediately so we can address the issue. If your complaint is not resolved to your satisfaction, you must notify us in writing within 14 days of the end of your tour.

 

13. Data Protection

We are committed to protecting your privacy and will only use your personal data in accordance with UK data protection laws. Your information will not be shared with third parties except as necessary to deliver the services booked.

 

14. Additional Information

a. You must adhere to any instructions provided by our guides for your safety and the safety of the group.

b. We reserve the right to exclude any participant from the hike if they act in a manner that is disruptive or endangers the group.
